Ringera and Corruption

One of the tactics to employ when debating is to constantly change the topic, misinterprete questions raised, form your 'own' questions and pretend that those new questions are exactly what your opponents asked and then proceed to answer them. It is a tactic I have used over the years to get the better of anybody in an argument. I am particularly at ease with a careless opponent who thinks there is such a thing a synonmns - two or more words meaning the 'same' thing. That is because I strongly believe in the power of words and have never entertained the thought that two words could ever mean the same thing.

So here we have Ringera. I do not think he has chosen this approach on his own. There must be some amateur behind him. I see traces of mistakes that can only be made by some man trying to learn the ropes as he goes along. For an analysis of their tactics pleasetune in another time.

Ringera was all over the media complaining that he was being accused of being corrupt. He must have known that would be a hard sell because he pinned the charge on the pro-government Daily Nation. Then he listed many cases but left out the names for Mutula Kilonzo to name in parliament this afternoon. That is because Ringera knew that if he named anybody at his press conference, it would both prejudice his case and open him up for private defamation suits by highly resourceful people. So he chose to exploit the freedom guaranteed MPs. I thought that was very mean. However as I shall show, this may well be his biggest mistake. The strange thing with doors is that once open people inside get out and those out get in and in no particular order!

I do not recall anybody ever accusing Ringera of corruption. God forbid! The man earns 2.5 million per month and thanks to his law office partner Kiraitu Murungi, he has a parachute deal that would make those Wall Street upstarts turn red with envy. If one were to start somewhere, then Ringera's judgement would be brought under review:

1. How could a man whose job is to fight corruption not ask Kiraitu Murungi to recuse himself from negotiations and signing of his contract on the grounds that they had worked together as partners in one law firm which they still owned;

2. One of the most important prerequisutes for becoming the Director of Kenya Anti Corruption Commission is a high degree of personal integrity and decorum. Since a large number of people including the majority of parliamentarians have expressed doubts about his commitment to corruption, does Ringera still think he has the integrity the job requires?

Ringera must have thought of all the foregoing and decided he was still qualified. So a decision was made to fight it out. Hence the statement and the further spilling of the beans in parliament by Mutula Kilonzo.

The spilling of beans will be easily dismissed as a poor attempt at blackmail. Already 90% of the MPs and ministers on the list have not been 'vocal' at all and can deny any vested interests.

There is another angle to the whole thing: Most of the MPs and ministers are from Raila Odinga's ODM. That confirms the contention that Ringera has been using KACC as a tool in partisan politics. Missing is the name of Amos Kimunya, George Saitoti and others associated with some of the most recent mega corruption deals. Common with the missing is their closeness to President Kibaki.

There are simple observations one can make:

1. Nobody is on record accusing Ringera of not placing people under investigation. Since no known person made that accusation, I want to assume Ringera has done it himself. In other words it is Ringera who is accusing Ringera of not investigating people. It is the same Ringera who then proceeds to answer his own accusations by causing the names of MPs and ministers to be tabled in parliament by Mutula Kilonzo.

2. It does not matter how many names Ringera tables in parliament. It will not explain the apparent willful incompetence and laziness on his part.

Finally the two committees that have recommended his removal specifically stated that they only addressed the process used to reappoint him and at no time did they discuss or comment on his performance - something they said belongs to the KACC Board.

The Fox and The Rooster

Anybody heard of the story of the Cock (Rooster) and the Fox? A long time ago, there was a Fox that loved to eat chicken. He could trap hens that strayed from the farms and have a good meal. He had one problem though - The Cock. With its blood red wattle and comb, is looked like it was always carrying a ball of fire. The Fox naturally feared that The Cock could set its fur on fire at will with its ball of fire. So it stayed away and in fact any hens that moved in the company of the Cock were left alone by The Fox. This went on for some time.

Then one day, the Cock realized that every time he ran in to The Fox, it ran away with great fear leaving a trail of smelly excreta and pee in its wake. It was clear to The Cock that The Fox lived in great feat of him. He could not think of any reason why The Fox would be so scared of him. He (The Fox) was a much bigger animal with speed and multiple defence and offence tactics, how could he fear a small bird? He resolved to find out what it was all about and make peace. He also realized that it might actually put an end to the slaughter of the hens which he secretly suspected The Fox to be behind. So when they met the next time, the Cock made sure that the Fox stopped to talk.

For The Cock realized that every time he moved a little towards the Fox, he shook with fear and urinated and excreted in his own pants. He was making a great pretence of being comfortable. Many such meetings were held but always ended when the Cock had to crow. For whenever The Cock was done with the crowing, it would look around and lo! The Fox was gone.
The Cock decided to settle this once and for all by making one last diplomatic move. He invited The Fox to his home as a sign of sincere friendship. After much hesitation, The Fox decided to attend.
He was served pickled mushrooms – to enhance the appetite followed by mulligatawny soup. The Cock then served some light Pasta – to show off evidence of his wide travels. For the main dish were served ngege, ugali, sheep testicles (which The Cock had accidentally trampled over in the bush) with red wine.
The Fox loved the wine and drowned many a portion with glass after glass of wine. The Cock followed suit despite a strong warning from the hens that his body and mind could not tolerate a more than average consumption of alcohol. It did not take long for both Fox and Cock to loosen up.
The Fox gained the courage to ask The Cock a question that had been disturbing him for a long time.
“Friend”, started the Fox, “how do you manage to sleep in your bed without setting fire to the entire bed with your ball of fire?”
The Cock, after finding out what The Fox meant and realizing that he had discovered the source of all that strange behavior on the part of The Fox, could simply not hold his laughter at all. He laughed and laughed until his ribs ached. When he had calmed down, he told The Fox that indeed the wattle and the comb were not made of fire and that they were just red and completely harmless.
“So you mean even if I touch it, I would not burn in an instant?” asked the excited Fox
“Not at all”, answered the now drunk Cock “here, come and touch”
A still timid and apprehensive Fox moved slowly with heavy feet and with great caution extended his hand to touch the Cock’s head. Yes, he confirmed it was not dangerous. Now it was his turn to laugh at himself for his foolishness. It was late evening when he left The Cock’s home and staggered to his cave.
The next day, it was an entire skulk of Foxes that descended on the chicken home. They killed the Cock last. They wanted him to watch.

Florence Jaoko - Who Are You Kidding?

The Kenya National Commission on Human Rights (KNCHR) re-published its report on Post Election Violence and gave me one more reason why no Kenyan should go before any kangaroo tribunal set up by Kibaki and his cohorts.

How can I support a list of names issued that has somehow manage to exclude the name of the then Internal Security minister John Njoroge Michuki? The shoot to kill orders issued publicly by this man would attract 'crimes against humanity' or even 'genocide' charges! We know that this man participated in several meetings at state house in which plans to rig elections in favor of Kibaki were discussed. He is reported to have dismissed possible protesters as 'mere jaluos who will run at the site of a gun'

Others who attended the said meetings were:

The Chief of Defence Staff
All the Provincial Commissioners
The Police Commissioner
The Head of the General Sevice Unit
The Head of the Administration Police
A wide range of former military servicemen

We also know why Kibaki travelled all the way to Machakos to visit Gen. Jackson Kimeu Mulinge.

Mwai Kibaki - The Hypocrite

Last week, amid publicity, Mwai Kibaki and an entity unknown in Kenyan law and public administration by the name 'First Family', sacked an ordinary citizen from his job at State House. His offence: Buying more luxury cars for the President, President's wives and children at a time of austerity! For this Kibaki was wildly cheered by his court poets and hangers-on.

When the cheering was over, Kibaki decided to 'secretly' create 13 new provinces and stuffed them with highly over-payed mandarins at the level of directors or some such level. It is to be assumed each of these mandarins will - as usual need three luxury cars. One - a Mercedes - so that the big man keeps speed when riding in presidential motorcades whose minimum speed I am reliably told is 230 Kilometers per hour. Any small Japanese car would never reach those speeds.

The second car - usually a Land rover or Ranger Rover - is for the chieftain to use when 'inspecting projects' in the rural areas.

The third vehicle - usually a Volvo is for the big man's wife or put differently for the provinces 'First Family'. This apart from facilitating the movement of the First Lady of the Province, ensures that children are delivered and collected from schools and kindergartens, attend parties and generally feel comfortable.

A new province will come with new officials. New buildings would have to be put up. I am informed that the cheapest new province will cost 1 billion Kenyan shillings just to set it up and much more to run.

Please do not forget that there are now 210 districts in Kenya. Most of these districts are illegal.

So Kibaki makes the saying 'giving with the right and taking with the left sound strange. It really is 'giving with one finger and grabbing with all fours'.

I have been reliably informed that Kibaki is planning another coup - this time with Uhuru as the beneficiary. Such moves as these convince me the man is serious. I watched Kibaki prepare to rig the 2007 elections. He knew that it will lead to bloodshed. He simply never cared. To this day, Kibaki remains unapologetic about his actions. He has never found it in his heart to look at his age and contemplate the future of his family. Humanity can be very brutal and unforgiving to the offspring of a dictator. The same humanity would bend over backwards to accommodate the child and grand children of a humble and beloved - generations after he passed away. If Kibaki or one of his supporters can show me the prospering son of a former dictator, I would say let Kibaki go on killing Kenyans.

Finally, could anybody tell me what Kibaki hopes to gain from increasing the number of districts and provinces? The word on the ground is that he is out to grab Kalenjin and Masaai territory for his tribe. I am bound to agree based on the past actions by Kibaki and the fact that I can hardly think of any reason why he would be setting up new districts.

For the record, not a single minister has surrendered his / her mercedes since Uhuru Kenyatta issued his anti-big car edict. Journalists who kept vigil at the gates of state house for any news from the unusual cabinet meeting were witness to the greatest opulence ever seen in a poor country. Every minister came in a mercedes. I have yet to hear what Uhuru used.

The Cost of Having a Prime Minister

It is official and in print: The tax payer shall cough out a whooping 33, 000, 000 to refurbish the private homes of Raila Odinga who is also the Prime Minister of Kenya.

If anybody still thinks Kibaki is a fool, that person better think twice.

Here is the big picture:

1. Kibaki has just rejected 5 or more luxury vehicles. The vehicles were not even personal but belonged to the state which then allowed him (Kibaki) to use. He would be required to surrender them on the 29th of December 2012 or upon resignation or death (whichever comes first).

2. Raila has just accepted to have his private home to be refurbished using government money. None of the improvements will belong to the government. He will keep the improvements and reap all the benefits whenever he leaves office. In event another prime minister comes to office, the state would have to spend the same or more money to bring the new person's residencies up to Prime Minister level.

A number of questions arise here:

3. Is Raila aware that real people are dying in Kenya as a result of food shortages? How does this play to the donors and others well-wishers who are being asked to bail out Kenya? Does he need a house in Mombasa as well?

I would have supported a new house being bought for the Prime Minister which would remain state property even when Raila ceases to be PM. May be somebody could have spoken to Moi to allow his former house in Kabarnet Gardens to return to the State for use by the PM. The government could also reposess some of the buildings and plots it once sold to well connected individuals in the 80s and 90s at throw away prices, well, on the same terms as they were sold. Whaever the case, more questions arise:

4. Does Raila and ODM still think they are on the side of wanainchi and Kibaki is not? Is Raila aware that 33 million is what it takes to educate 55 university students with each earning a Bachelors degree?

We have seen some level of wastefullness on the part of Raila that is fast creating a pattern that will be too hard to run away from.

Me and Toa Toa Princess

I was tipped off and sneaked to RCB to read this by Toa Toa Princess.

I now believe people do not understand why I have to leave RCB for good and hope it dies of natural causes.

She has stumbled on one of the reasons but still wants me to stay put. Touching.

I am leaving to protest against loaders (like the infamous moderator) who produce nothing but are ever present to undermine those who produce.

The moderator I am protesting about is known for simply deriding what others produce. I have never once read any opinion (beyond derision of other netters and what they post) from him on any issue. He posts highly tendetious one liners which try to show:

1. He is very wise
2. Others are unwise
3. He is not a tribalist
4. Others are tribalists
5. He loves Obama despite Obama being a Luo (see below)

He pretends to be a fan of Barry Obama and for that is an expert in posting links to stories and videos of Obama. I would believe him too if he wasn't trying too hard.

That, he thinks is what the RCB BB is all about. When a netter comes up with an original view - which distantly appears to be critical of his tribe - he loses his entire head: He derides the posting misuses his power as a moderator in several ways among them removing such a post from 'sticky' status which some other moderator would have given it.

Limited intellect is his problem too. Not every article that mentions tribe negatively is tribalistic. It requires a degree of intellect (which I hold that the said moderator lacks) to make a determination of what is tribalistic and therefore to be struck down and what is essentially harmless debate.

Well, the last time I had quite a run in with Toa Toa Princess. So I am surprised. I can't post my blogg on RCB, but it is freely available here and you can leave comments:

Too bad Tingisa.

I joined Bowen about a year ago for a number of reasons, including seeing one of your posts that addressed the issue of emotional child abuse. I remember thinking that here was a place where Kenyans have fun, but also discussed serious issues.

Maybe one day you will tell why one person has gotten under your skin so much. It's hard for some to understand how cyber relationships can turn so sour.

How Do You Quell A Riot

I saw this topic on my way out of RCB.

I assume the writer was saying something else like if a government is going to get indicted by the ICC for quelling a riot how then may that government legally snuff out a riot without attracting a warrant of arrest?

He might want to read about the various definitions of riots. He should pay great attention to the meaning of 'Police Riot'.

Note also that the establishment likes to use the word 'riot' and not for nothing. 'Riot' is a an offence for which clearly spelt out sentences exist in all countries. Organizers of such gatherings on the other hand like to use the word 'protest'. Again this is not for nothing either. Protesters are a protected lot by law.

So usually the government would first convert any peaceful protest in to a riot then feel 'justified' to quash it. However since this tactic is now known, it constitutes an offence to give orders to attack peaceful protesters.

No one has ever been prosecuted even where the warlords make public statements encourage mayhem. In such an scenario, i wonder what being "patriotic" and "sovereign" is all about. If being sovereign and patriotic is to let warlords get away with all sorts of evil, then i want nothing to do with "sovereign" and "patriot".

If ICC can just indict and arrest just THREE Kenyan warlords, then their foot-soldiers, hanger-ons and other warlords wannabe will think twice before undertaking such mayhem again. Thus, welcome O'Campo & Co. to end impunity."

The Crimes Against Humanity List

There are two sides to this issue: PNU and ODM.

The PNU view is that Kibaki won the elections fairly and then Raila incited people against him and his people the Kikuyu. For evidence PNU cites the many IDPs and deaths of Kikuyus in Rift Valley.

ODM on the other hand says Kibaki knew he was going to lose the election just as he had lost the referendum. He decided to avoid defeat at all costs even if it meant people dying. So he started planning how to rigg elections and how to beat any protests against him. In this he was assisted by instruments of state terror such as police, GSU and the APs.

But first to the list

Everybody including the government of Kenya is speculating on who is and who is not on the Crimes Against Humanity List composed by the Waki Commission on Post Election Violence. Here is Tingisa's list:

  1. Emilio Mwai Kibaki - Duly Elected President of Kenya
  2. Raila Amolo Odinga - Duly Appointed Prime Minister of Kenya
  3. John Njoroge Michuki - Duly Appointed Minister
  4. George Saitoti
  5. Uhuru Kenyatta
  6. Brigadier Ali - Police Commissioner
  7. GSU Commandant
  8. Stanley Murage
  9. William Ruto
  10. Frankline Bett

Of these people, Ruto will be the first to be sent to The Hague. That is because the perception in the public mind created by Moi and sons as pay back for beating them on their own home front is that everyone believes he is guilty of something. However Ruto will also be the first to return from The Hague triumphantly.

Of the remaining lot, no charges will be preferred against Raila, Uhuru and Bett. They will however never get a clean bill of health from the ICC. By that their international reputation will forever suffer from blemish. However Kibaki, Ali, Stanley Murage and this GSU commandant may be a long time in The Hague.

Register More Voters

If I recall right, Kenya did not get such a bad name by the failure to register enough voters. In fact the opposite happened! There were more registered voters than living Kenyans.

So you can imagine my surprise when I read that political parties gathered for breakfast with Kenya's Interim Independent Electoral Commission (IIEC) and all they could say - out of a million burning issues - was "please register more voters".

Why is it that Kenyans never want to learn from mistakes? Why can't the IIEC simply address the reasons Kenyans got rid of the Kivuitu team in a hurry?

Let me be part of the solution:

Multiple Registration:

This is not just a RCB problem (courtesy of a certain moderator), it is a perfect Kenyan problem. People go to different parts of the country to register over and over so that on election day, one such individual is capable of electing an MP single handedly. The process where human beings go through the entire register manually to detect and remove multiple registrations is simply not up to the job.

Solutions:

1. Computerize the voters' roll
2. Introduce biometric registration where the finger print and/ or eye of the voter combine with the name and face to positively identify a voter with no margin of error
3. Introduce 2 above at every polling station
4. There should be a paper trail in addition to all this above in event of a dispute

Somebody is going to mention cost. To that person I ask, how much does your life and that of your child cost? In any event we are now paying out billions to commissions to fix what transparent ballot boxes could have prevented.

I expect an IIEC that would stay a head of modern technology. The Kivuitu team not only feared technology, it hated any moderate advances in electoral practices.

Mutula Kilonzo and James Orengo Bring Down Bricks on their Bosses

If you have ever known a clumsy person, then you also know that such a person can be dangerous to limb and life. Both ODM and PNU must be feeling like they swallowed several live wasps who are now working their stomachs.

It all started with the decision by Mutula Kilonzo to head to The Hague. He must have had a very low opinion of Koffi Anan. He somehow managed to convince those who matter that taking the short trip to The Hague would see the idea of an international tribunal to try the big names behind the election violence in 2007/ 2008 dead and buried. Mutula is not a man given to thinking small. His grand vision of events in The Hague comprised of an ICC prosecutor who would accede to every demand by Mutual Kilonzo. In fact he was so sure of his success that he took time off to tell off Koffi Anan. The Standard drew attention to the tiff in tabloid fashion: Mutula Scoffs at Annan...

For those new to Mutula Kilonzo, he is the minister who planned to construct the largest lego city in Africa - complete with special highways for the President, Prime Minister, ministers and other VIPs. He thought a helipad to give VIPs a headstart on the traffic jams towards the airport was a good idea.

Not to be outdone, ODM threw in James Orengo.

Now there is a reason why somebody decided to include breaks on every moving car.

The team met Koffi Anan. He told them his piece. They had to have the tribunal in place by August or he will hand over the envelope.

Wiser men would have rejected his offer for them to talk directly to the ICC prosecutor. The prosecutor would never move if the former secretary general of the UN sitting together with former presidents Benjamin Mkapa, Joachim Chissano and the wife of a living legend Nelson Mandela is telling him to stand still.

The team went to the Hague and a few days later Anan made his own trip to The Hague with an envelope in his hand.

The mission to The Hague was a disaster.

Richard Bowen's Elections

Phase one of the elections at RCB has just been completed. Looks like all moderators who chose not to resign have been retained. It is unlikely I would have served had I been elected any way. The terms of my contesting were sadly not met.

I stated that if one of the moderators gets re-elected I shall not serve alongside him. He has a huge tally of votes of which I am made to understand none included the many new handles. It appears out of all the new handles four or so voted for me ( and their votes were deducted from my total). Still none voted against me or any other candidate (at the time of going to press). It is amazing that none voted for or against Mla Chake.

Any way a full summary of my take on the election will be forthcoming later. Right now my supporters are more hurt than the candidate. It hurts me that they are so hurt.

I shall go to bed soon and when I wake up, will consider listening to all the good ideas that I have heard this long night. I am not entirely against the idea of patronizing an alternative site. It pains me though that I would undermine the work Nene and I did back in 1996. I urge supporters to stay calm. Do not plaster RCB with complaints. It does not work and works to build the egos of your detractors. Use your heads and consult as you have been doing.

For those waiting for the usual speech, save your lantern oil. I shall not be writing any surrender speeches any time soon until I am convinced that stories about unfairness in the process are untrue.

Beth Mugo and Publicity

For someone who yearns for publicity - Beth Mugo must be feeling on top of the world this week. She got her Swine Flu and nothing attracts the media better than 12 cases of swne flu.

She has had this running war with Anyang Nyong'o over who controls what in what used to be one ministry before Kibaki rigged elections and demanded to share government with the winner.

Trouble At RCB

I woke up one day to find fire at RCB. As I write the fire brigade has not yet declared the fire extinguished.

They had it coming. For a long time I campaigned against the idea of moderators. I once returned from vacation and found moderators in place. So began the campaign to get the new supervisors act less like village headmen who 'fine' villagers cash and several hens, which they then slaughter, cook and wash down with liquor paid for by the 'fine'.

For starters, I advocated against moderators heavily participating in debates. However since they are free human beings whose rights cannot be violated, I suggested that they simply avoid moderating the debates in which they are participating because such an act amounts to ad hominem. A moderator who suddenly pulls out his moderating hat amid a debate reminds me of the girl I grew up with who would borrow her mother's bicycle for us to play with in some childish competition. The 'game' would go on as long as she was winning but once she starts losing matters would take a different turn. She would suddenly withdraw the bike without ceremony.

I still wonder how Rich could have been so blind not to see the express bus driven by a madman crashing his way.

Kenya is a tribal society in every way you look at it. The President of Kenya uses tribe to decide who sits close to him. The country's key insitutions are now shamelessly headed by his own tribesmen. It no longer requires substantiation and anybody asking me to name names better bring along a huge container for me to pour them in.

Every minister (apart from hapless Mwakwere) appoints tribesmen to all parastatals within his ministry. There are no exceptions beyond the above mentioned. Thus if the minister is a meru, be sure that all parastatals within that ministry will be headed by merus. And if you find luos controlling the parastatals, don't waste your time and money going for a brain transplant. It is no teaser! The minister would be a luo.

So how did anybody expect a place where Kenyans have been gathering for the last 14 years to be free of tribalism?

I hope and pray the site survives the latest tremors. I helped promote that site. The man who should get the credit for promoting the site more than anybody else is a Mr. Nene. This guy sent out emails and so on to every Kenya with a keyboard. I wonder where he is? (see story elsewhere).

The PNU Inspired 'Maize Scandal'

The Kenyan news media is plastered with headlines on a maize scandal. This time it is not William Ruto at the centre of it. Lo and behold, it is Prime Minister Raila Odinga!

First, I wish to advise Raila to find a proper PR person and fast. Some of the things I read in the standard attributed to his communications director are plain damaging and can send an innocent person to the gallows.

When I grew up I was repeatedly told that the Fourth Estate was objective and check out stories before publishing the same.

Consider this:

A few weeks ago, the media went ballistic on Agriculture Minister William Ruto accusing him of 'stealing maize'. This despite the fact that a simple check of the ministerial portfolios as published by the Office of the President wouød have shown that the said maize was never under the ministry of agriculture. I have yet to see a single apology from any quarter for smearing William Ruto - particularly after the minister in charge - Naomi Shaban - turned up to own the lost maize.

When I saw a huge image of Raila on the Daily Nation, I expected to read how the PM had been enriching himself personally from the maize imports. Instead I find circumstances described which then lead to the naming of "Raila's Family". One would think family would include more than one member of Raila's clan.

That granted, why on earth is the picture of that member of the family replaced with that of the Prime Minister?

Now we all know that last Tuesday was not a good day for the Party of National Unity (!) The Speaker of the National Assembly made a ruling that many would find neutral. Not so for PNU that has interpreted it as a 'victory' for Raila Odinga. Can they now convince a child in Kenya that the whole maize scandal is not a revenge attack against the man they believe beat them in parliament?

Ngungi Wa Thiong'o and the Bondo Society

I will perhaps expound on this one day. Ngugi wa Thiong'o is the main inspiration of the Bondo Society in Sierra Leone. Perhaps it is time to find out what the society stands for.

A hint: His description of Muthoni is used to prepare young Sierra Leonean girls for circumcision rituals. He is a hero over there. His portrayal of christianity is also celebrated in many countries in Africa. The guy is a hero.

Koigi's Metamorphosis

The World has turned upside down. Last week, I thought I read somewhere Koigi Wa Wamwere speaking either neutrally or positively about Raila Amolo Odinga! Koigi is known for finding just about any excuse to throw stones at Raila Odinga. For example in the run up to the last general election in Kenya in 2007, Koigi Wa Wamwere, who had since become a leading Court Poet charged with singing the sweetest panegyrics to Mwai Kibaki, launched a propaganda war on Raila and ODM. Like a good propaganda war, it was clothed in intellectual jargon. Our people have, since education came to Africa, learned not to question the wisdom we learn at school. So Koigi wrote:

At the heart of the current political contest, therefore, is the question whether a full-blown transition from the closed ethnic nation and its nation-state into a democratic, open nation and nation-state or the democratic transition began in 2002 will be aborted. Put simply: Shall Kenya proceed with ethnic nation-building or democratic nation-building?

Once I reached this point, I made a quick reverse to see if I had missed something. After all, Koigi was writing in a newspaper. I was sure he would remember to define what an "Ethnic-Nation" was and how that differed from a "Nation-State". Sadly there was no attempt to define those terms. So I took to thinking about the terms on my own - something I would not recommend to anybody.

I notice that Koigi equates "Nation-State" with "democratic nation-building". The way he presents his case, makes me assume ethnic nation building is the opposite of "democratic nation building" and it is negative. According to Koigi Wa Wamwere, Kibaki is the democrat while Raila is the tribalist. So I started wondering: How accurate is that? Kibaki stole the election. The winner (Raila) did not? Kibaki trashed every democratic agreement between him and his partners at will, Raila has never dishonoured a single agreement; Kibaki single- handedly appointed the ECK contrary to the IPPG agreement between political parties (he preceded this by refusing to present it in parliament to turn in to a law); Raila has yet to trash IPPG? So what yardstick did Koigi Wa Wamwere apply?

Still Koigi writes:

In the struggle between the ethnic nation and the democratic nation and their variants of nation-states in Kenya, the modern nation-state will only triumph if Kenya is successful at promoting an inclusiveness based on opportunity.

Boy! Didn't struggle to get some meaning out of it?! I caught a smell of innuendo.

Ababu Namwamba of the Grand Opposition

This afternoon in Kenya, I started to see something of Ababu Namwamba's idea of mounting a Grand Opposition to the government. He fought so hard for the post of Leader of the Official Opposition - despite his party being squarely in government.

Yesterday, a leaflet was being tossed about the globe bearing the names of the Maize Mafia - in other words the gang that together or acting alone had ensured that the country lost its strategic food reserves to the high paying Sudanese. On that list was Ababu Namwamba and others.

I was surprised and wanted to dismiss it as mere propaganda - the is plenty to go around both earth and Mars! In fact I had written off the piece of paper entirely. Even if Bonny Khalwale - who always reminds me of Chief Nanga of 'A Man of the People' fame - had harngued the House a little more, I still would have dismissed the paper as nothing short of an attempt at becoming a neo Joseph Goebbels. That lasted until Ababu Namwamba stood up in the House to name the First Lady.

I have no idea what Lucy has been to nor am I particularly bothered. Lucy is a lady struggling with a lot. She has put up a spirited struggle in the face of heavy odds. It is no secret in Kenya that Lucy has a challenge. She has borne it with great courage and determination. Where many people would have given up and resorted to heavy medication and institutionalization, Lucy has remained visible whenever possible. She has in a way given a face to a problem Kenyans have difficulty in dealing with.

I have great difficulty believing or imagining Lucy would buy and sell maize in Sudan. At best, somebody has used her name to set up a company which has acquired a life of its own. Ababu Namwamba should know this. In fact I belive he knew this quite well before he got on his feet to utter his accusations.

Having said that, two wrongs make no right. What he may have succeeded in doing is simple - he has given Kenyans a list of those involved in the maize scam with him. His crimes against the people are in no way ameliorated by the mention of Lucy's name. He has stooped lower than the low by naming Lucy. A man who aspires to respectability and bears the title "Honourable" before his name, must also adhere to honour. I know of only one group of people among whom honour is unknown. Yes you got it right - highway men and cut-throats.

Now we know his quest for the title of "Leader of the Official Grand Opposition" was a selfish grab for the perks that go with that office no altruism whatever. What a shame!

Sunkuli in China

I have it upon impeccable authority that former internal security minister under Daniel Arap Moi - Julius Sunkuli - advocate of the High Court - is the new face of Kenya in China. He joins Kibaki and Obama in being addressed as "His Excellency".

What has Sunkuli excelled in?

Yes, he was a magistrate in Kericho for a long time. I cannot claim to have read or heard of any trend-setting judgement by him while on that bench. So he must have excelled elsewhere.

Then he became a member of parliament. Yes, here he may have scored a first. He was the first MP to actually represent a district. His constituency was the same size and shape as the district. For those unaware of Kenyan administrative norms, a district in those days would be composed of many divisions (themselves composed of locations headed by chiefs and sub-locations headed by sub-chiefs). A division was headed by a division officer while a district would have both a district officer and a district commissioner. All this was the creative work of Jaramogi Oginga Odinga (see Not Yet Uhuru for a full confession from him). Sunkuli therefore was an MP with a DC, DO and DO. No other MP can take that way from him.

As minister for internal security, Sunkuli did not excel in anything. He came off as vain and rather power hungry. He lacked the calm and calculating image of GG Kariuki; the power and clout of Charles Njonjo or the determination and focus of Justus Ole Tipis. He certainly could not match the independence of Burudi Nabwera to name just a few of the past holders of that office.

It was however the death of Father Keiser and the Papa Dennis affair that brought Sunkuli to the fore.

The question of father Keiser shall be left for another day. For the record, Sunkuli has denied any involvement whatsoever and the FBI has declared the late Keiser a suicidal maniac. I have disagreed with that opinion most strongly.

On the Papa Dennis affair however I have some questions!

Was not mama Dennis under age by the time she conceived? If so, what does the law say about statutory rape? If he were in the US or Europe, would not his name end up in some register? Are his neighbours in China going to be warned that His Excellency the Child Molester lives in the neighbourhood?

What I actually Wrote....

At the height of the brief civil war in Kenya in 2007, I was a very angry person. On January the 13th, 2008, I responded to what I still think was pure pro Kibaki propaganda. It was a goebbelsian piece spiced with half truths and blatant lies. I sought to refute it.

Well, my posting at RCB has become viral and has been edited and re-edited to suit varying interests. I am therefore reposting it here as it was. Please diregard other versions.

Here we go:

"Haba

Please produce any evidence of this stupid propaganda. Raila in his evidence simply stated that he was aware that Njonjo was plotting a coup and nothing else. He testified that while being interrogated he stated the same to police commissioner Ben Gethi who tore the statement and forbade him from pursuing that line.

Consider these inconsistencies:

1. Kibaki promised to run for one term: He denied it two days after being elected and guess what he ran again and lost

2. New Constitution in 100 days: He is now opposed even to the mildest change of the current constitution

3. Promised to hand over power if he loses: Guess who is trying to hang on to power by force even at the expense of civil war

Kibaki is his quest for power lent his support to Moi. In 1978 when Jeremiah Nyagah, Paul Ngei and Jackson Angaine planned to stand for Presidential elections, Kibaki hurriedly convened a cabinet meeting and got all ministers to support Moi. This he hoped Moi would reward by naming him successor. He was made VP but nothing else.

On buying parties: Kibaki did not form DP, NARC, NARC Kenya or PNU. He seized all these parties except NARC which Ngilu steadfastly refused to hand over despite being offered to be bought, induced, threatened and even imprisoned. All this so that Kibaki can be at the helm. He has now crowned this megalomania in front of the entire world by stealing an election. FYI DP was formed by John Keen with money from Njenga Karume.

On Joining LDP: Raila was the main force behind the Rainbow coalition which incidentally included Saitoti and Kamotho. He was among the founding members of LDP which had been secretly registered to prevent Moi’s inteference. Compare this with Kibaki joining KAU, KANU, DP, NARC, NARC Kenya and now PNU. I guess that makes it one party more than Raila. Talk of party hopping!

I am sure the whole world has seen Kalonzo’s “popularity” which stood at 9% (a shame even by the discredited ECK standards). May be you believe your own lies when you re-write history casting Kalonzo - a party thief - as a popular democrat.

Correction: The MoU with muslims has been publicly disclosed. If you dared venture out of your cave for a shower and dental care, you might actually read a copy. The only people who will cause religious problems is your lot who see trouble where there is none.

Please address the MoU that Kibaki signed with the same muslims in 2002 or shut up. State how it was OK in 2002 but wrong five years later. Is it because in 2002 it was your tribesman and in 2007 it is a Luo? Do you base your judgement on a person’’s tribe?

Nahashon Njenga Njoroge

This man who allegedly shot and killed Tom Mboya and was reported to have been hanged in secret at Kamiti Maximum Security prison appears to have ressurected and moved to live in Likoni for many years before he was killed (for real) by the so called "raiders" during the 1997 civil war at the coast of Kenya.

When I went down to check the story, I came over a bar cum residence which is supposed to be the late Njenga's. I could not trace his grave. You can be sure this isn't the last word.

Mungiki

In 2002 while in Nairobi and seeing Moi trying to use Mungiki to support Uhuru, I got in to trying to find out more about Mungiki.

Several meetings with journalists, reporters and policemen, I quickly reached the conclusion Mungiki was an over glorified gang of chicken rustlers injected with low-level politics of survival. Mungiki appears to have emerged to fill an existing vacuum for hitmen, trouble-makers and other hired gangs needed by corrupt politicians.

The members lack any kind of ideology, value or serious issues. Violence is both a means and an end. For example they have to remain violent and publicly so to attract handouts from politicians.

I found that both KANU (the ruling) and others had at some point bankrolled Mungiki. There are also several Mungiki's most set up for the convenience of securing funds from willing politicians.

I am however convinced that the menace will be wiped out easily as the police, military intelligence, Special Branch, GSU, regular police etc can simply not stand Mungiki and have at times launched suo moto expeditions against them.

Letter to Justice Gicheru

Dear Justice Gicheru

I refer to your comments in the [url=http://www.eastandard.net/news/?id=1143981917]Standard[/url] in which you have attempted to defend the judiciary - which you head - from accusations levelled at it "by politicians". It is your defence I seek to discuss.

You point at what you consider "hypocrisy" on the part of politicians and cite among other things the fact that some of these critics have filed petitions and responses to election challenges filed against them by their opponents in the recently bungled election. I must assume you are referring to the decision by Raila Odinga to file a response to what I consider a frivolous election petition filed by a Mr. Stanley Livondo also known as "Mr. Money Bags".

At no time did Raila deny that you have the power to pass judgements including allowing non-contested election petitions. Your colleagues have done the same in the past as has been pointed out, all bad judgements may be repeated with increasing "legality". So your power to pass judgements whether fair or not, was not, has never been and is not under question. What has been questioned is your impartiality.

Any man who feels you are inclined to judge in his disfavour, and desiring to hold on to the status quo for as long as possible, will nevertheless offer a defence against whatever charges brought against him - even if only to delay what he might assume to be inevitable. Yet nowhere does filing such a defence against a process that is suspect imply legitimatizing a crooked sysstem. Are you suggesting that you would not have acted adversely against Raila if he had failed to enter a defence in the Livondo petition? Would you have told Livondo to hold his peace while you sought Raila to give his side of the story and failing to get him told Livondo to go away as you could not possibly pass a judgement against an unheard man? Not likely. You are, in my opinion fudging facts. You are measuring height and weight with the thermometer.

Please enlighten Kenyans on how the police came to be involved in the serving of summons on behalf of private citizens - which Stanley Livondo is? When did the courts under you dispense with bailifs and Process Servers whose job it is to deliver summons to defendants in civil matters? Was your judiciary lending itself to be used by the Kibaki government? How do you expect Raila or any keen observer to see your courts as impartial when such breaches are not only tolerated but ignored?

You have protested your impartiality by your criticism of those suggesting otherwise. Mr. Hon Chief Justice I have to ask you to respond to the remarks attributed to the Chairman of the Electoral Commission, Senior Counsel Samuel Kivuitu. Recounting the events of 30th December 2007, he states that he arrived at State House minutes after announcing the disputed results and found you waiting to swear in Mwai Kibaki as President. When did you know Kibaki had "won"? He also stated that armed policemen were sent to collect the Presidential Election Certificate to be delivered to you at state house. Were you part of the group that so dispatched these armed men to a holder of a constitutional office? If you were not, what is your reaction to the adverse implications of Kivuitu's statement?

As the Chief Justice of Kenya, what steps have you taken to resolve the election dispute that is threatening to tear this country apart? What has prevented you from taking suo motto notice of the electoral dispute summoning the concerned parties and making a ruling? Is it because you agree with the status quo?

I would also like to get your response on the following:

1. How do you select the judge or judges to hear a given case? Is it true that you do not use a blind method of selection such as drawing lots but instead single-handedly decide which judge will hear which case? If so, has it occurred to you that some Kenyans might find that suspicious? Why has a lottery system not been applied especially in matters of national interest such as presidential elections?

2. Who appoints judges? Would you like to explain why judges appointed and ready to be sworn in are still not judges? Is it true that Martha Karua objected to their appointment?

3. Has it ever occurred to you that more than half of the entire judiciary are GEMA tribesmen?
I note and share your concern that politicians have over the last 5 years openly disobeyed court orders. What have you as Chief Justice with powers to deprive any citizen of freedom if found in contempt of lawful court orders done about it? Have you ever summoned any of the politicians and dressed him/ her down? Is it not true that what you are using the word "politicians" as both obfuscation and subterfuge instead of specifying the offenders as Kibaki's ministers and senior government officials?

Mwai Kibaki - The Longest Serving Member of Parliament

Mwai Kibaki was head hunted from his new job at Makerere University to come back to Kenya and be the executive officer of the latest party to be taken over completely by Jomo Kenyatta (He had taken over 3 other parties before this and led each one of them to ruin).

Kibaki was too young to contest for any seat and had to cool it for a while before trying his luck in Nairobi. The story of how he managed to rigg his way in is told elsewhere. Suffice is to say he got such a scare that he relocated to his home territory of Othaya - bribing the incumbet to go soft on him. He won and has remained the MP of Othaya to this day.

With the retirement of Moi and Jeremiah Nyaga, Kibaki became the longest serving MP in Kenya's parliament. If he were to really sit in the house, he would not lay his eyes on a single MP who was with him in that same house in 1969 - 74 or 1974 - 79. Most are out and dead!

So one would expect Kibaki to love parliament. It has been his bread of life for, well, all his adult life. One would expect him to be a champion of its rules, regulations and traditions. For example if parliament were to find it wise to impeach a person, I would expect Kibaki to be the last man to go to bed with the man. Kibaki, in my book, would be required to treat that person as vermin.

So, I have no idea why I expected Kibaki to re-appoint Amos Kimunya back to the cabinet. Perhaps I recalled the time as a university student, we visited Moi on one of his 'invite-and-corrupt-a-student'. Kibaki had just been fired from his plum VP job. A student asked him why he had fired Kibaki (he framed it in the most diplomatic way, I cannot even re-enact it).

Moi stood up animated. He told a parable or two in his characterestic stammering, halting andboring way. But he came up with a powerful conclusion:

"if you want civil war in this country, then make Kibaki president".

I must confess I that at the time, Moi was hiding his true intentions which would be to preserve his record as the longest serving vice president in Kenya's history. For a while I felt vindicated when he cut short George Saitoti's tenure at shy of the 12 year record of his.

No doubt Kibaki has scorned parliament by re-appointing to the cabinet a man parliament believes is unfit to hold that office. He has questioned the judgement of MPs (himself included). MPs (some of them) have responded with anger but no action.

It wont be the first time Kibaki has scorned parliament. When parliament sent to him a list of names to be appointed to the anti corruption posts, he picked and pecked - eliminating those not members of his ethnic group. He got away with it. He sent back laws to parliament to be re-made to suit is whims yet there is no constitutional provision for that. He is expected to sign all the laws that come his way (nobody thought a president could refuse to sign and therefore no provisions exist to address non signature).

So what is parliament doing about this man Kibaki?

so far nothing.

My view is that parliament should muster all it dignity (much as there is dearth) and expell Kibaki from parliament - whatever the consequences.
